This is my situation. My bf. and I just signed a lease, starting August 1st. At first the landlady seemed really nice.She wanted to do some work in the apartment, put a shower in a spot where it wasn't before, put washer and dryer and move a wall!!!This was 6/7 weeks ago.She got one and half month deposit + first month in her hands.We got no keys yet.At first she said that when the workers would be working, we could start moving things in and close the bedroom door.Three weeks ago, we saw the place again and there was no work started yet.So, I called her and asked, are you sure we are going to have an apartment ready on August 1st?She got defensive and said of course, you signed a lease!Now she changed her mind and she won't let us go into the place, not even to take measurements to see if we can fit stuff.She said no, the place will be avaiable on August 1st!My question is what can I do if the place is not ready and if she is not willing to give us the money back,to look elsewhere?

The only things that apply are the items that are written on the lease and signed by you and the landlord.
Everything else is just babble.
If the unit is unfit to live in, get the Housing committe in your locality involved. If they find it is uninhabitable, they will force return of your monies.
Anything that was NOT included in the lease i n writing cannot be enforced.
You have no right to possession until August 1. She is within her rights. She may view you as being pushy. If she does not deliver on August 1 have a backup plan. If you NEED to move then, then do so. She will have likely breached the lease if you do not get August 1 possession unless there is something in the lease to the contrary. You ae also entitled to your money back. But she may balk at this. So, I think you should work with her if at all possible.
by rights you can't do anything until 8/1 but if it is not ready then she has to pro-rate your rent for that month or give you your money back. read the fine print of your contract.

Your rights are whatever the lease states, and only what the lease states. If the apartment is not ready by the date listed in the lease, the landlord will be in breach of the contract. At that point, you can agree to modify the lease, or demand a refund and walk away.
